©ICC-CPI علي عبد الرحمن خلال جلسة المثول للمرة الأولى أمام المحكمة الجنائية الدولية
في 15 حزيران/يونيو 2020، مثل السيد علي محمد علي عبد الرحمن لأول مرة أمام القاضي المنفرد لدى الدائرة التمهيدية الثانية في المحكمة الجنائية الدولية، روزاريو سلفاتوري آيتالا. وقد عقدت الجلسة في حضور المدعي العام والدفاع، ومثل السيد عبد الرحمن، الذي حضر الجلسة عبر الفيديو، محامي الدفاع سيريل لاوتشي.
وقد تثبت القاضي المنفرد من هوية المشتبه به ومن أنه قد بلغ بوضوح بالجرائم التي يدعى بمسؤوليته عنها وبحقوقه وفقاً لنظام روما الأساسي في لغة يفهمها تماما. وقد تقرر عقد جلسة اعتماد التهم بصورة مبدئية في 7 كانون الأول/ديسمبر 2020.
والهدف من جلسة اعتماد التهم هو تحديد ما اذا كانت هنالك أدلة كافية يمكن معها القول بوجود أسباب جوهرية تدعو للاعتقاد بأن الشخص المعني قد ارتكب الجرائم المدعى بها. وإذا ما تم اعتماد التهم، كلها أو بعضها، تحال القضية إلى دائرة ابتدائية تجري أمامها إجراءات المحاكمة.

يعتقد بأن السيد عبد الرحمن كان احد اكبر القادة في تدرج المراتب القبلية في محلية وادي صالح وكان عضواً في قوات الدفاع الشعبي كما يزعم بأنه كان قائداً لآلاف من أعضاء ميليشيا الجنجاويد من آب/أغسطس 2003 إلى آذار/مارس 2004 على وجه التقريب. وقد وصل في 9 حزيران/يونيو 2020، إلى مركز الاحتجاز التابع للمحكمة بعد أن سلم نفسه طوعاً إلى المحكمة في جمهورية افريقيا الوسطة.ويعدد أمر القبض الأول الذي صدر في 27 نيسان/ابريل 2007 وأمر القبض الثاني الذي كان قد صدر في صورة سرية في 16 كانون الثاني/يناير 2018 ثلاثة وخمسين تهمة موجهة إلى السيد عبد الرحمن إذ يدعى بمسؤوليته عن جرائم حرب وجرائم ضد الإنسانية ارتكبت في دارفور في السودان.
وفي 15 حزيران/يونيو 2020، تقرر فصل القضية ضد السيد عبد الرحمن عن القضية ضد السيد احمد هرون، حيث ان السيد هرون لم يسلم بعد إلى المحكمة، وذلك بهدف ضمان حق السيد عبد الرحمن في اجراءات عادلة وسريعة.

On 15 June 2020, Ali Muhammad Ali Abd–Al-Rahman appeared before Pre-Trial Chamber II’s Single Judge Rosario Salvatore Aitala of the International Criminal Court (“ICC” or “Court”). The hearing was held in the presence of the Prosecutor and the Defence. Mr Abd–Al-Rahman was represented by his Duty Counsel Mr Cyril Laucci and appeared via video-link from the ICC Detention Centre.
The Single Judge verified the identity of the suspect, and ensured that he was clearly informed of the crimes he is alleged to have committed and of his rights under the Rome Statute of the ICC in a language he fully understands and speaks. The opening of the confirmation of charges hearing was scheduled provisionally for 7 December 2020.
The purpose of the confirmation of charges hearing is to determine whether there is sufficient evidence to establish substantial grounds to believe that the person committed each of the crimes charged. If the charges are confirmed, totally or partly, the case will be transferred to a Trial Chamber, which will conduct the subsequent phase of the proceedings: the trial.
Background: Mr Abd–Al-Rahman was allegedly one of the most senior leaders in the tribal hierarchy in the Wadi Salih locality and member of the Popular Defence Forces (PDF) and allegedly commanded thousands of Janjaweed militia from on or about August 2003 until on or about March 2004. Mr Abd–Al-Rahman was transferred to the ICC’s custody on 9 June 2020, after surrendering himself voluntarily in the Central African Republic. The first warrant of arrest delivered on 27 April 2007 and the second warrant published on 11 June 2020 against Mr Abd–Al-Rahman list 53 counts on the basis of his individual criminal responsibility for war crimes and crimes against humanity allegedly committed in Darfur (Sudan).
On 15 June 2020, the case of Mr Ali Muhammad Ali Abd-Al-Rahman was severed from the case of Mr Ahmad Muhammad Harun since Mr Harun has not yet been surrendered to the Court. This is done with a view to protecting Mr Abd-Al-Rahman’s right to fair and expeditious proceedings and in the interest of judicial economy.

Première comparution d’Ali Muhammad Ali Abd–Al-Rahman devant la CPI

Aujourd’hui, le 15 juin 2020, Ali Muhammad Ali Abd–Al-Rahman a comparu devant le juge Rosario Salvatore Aitala, juge unique de la Chambre préliminaire II de la Cour pénale internationale (« CPI » ou « la Cour »). L’audience de première comparution a eu lieu en présence du Procureur et de la Défense. M. Abd–Al-Rahman était représenté par son Conseil de permanence, Maître Cyril Laucci, et a comparu par liaison vidéo depuis le quartier pénitentiaire de la CPI.
Au cours de l’audience, le juge unique a vérifié l’identité du suspect et s’est assuré qu’il soit informé des crimes qui lui sont imputés et des droits que lui reconnaît le Statut de Rome dans une langue qu’il comprend et parle parfaitement. L’ouverture de l’audience de confirmation des charges est fixée provisoirement au 7 décembre 2020.
Une audience de confirmation des charges sert à déterminer s’il y a des motifs substantiels de croire que le suspect a commis ces crimes. Si la Chambre préliminaire décide de confirmer les charges, en tout ou en partie, elle renverra l’affaire devant une Chambre de première instance, laquelle sera chargée de conduire la phase suivante de la procédure, à savoir le procès lui-même.

Contexte : M. Abd–Al-Rahman serait un des membres les plus éminents de la hiérarchie tribale de la localité de Wadi Salih, qui faisait partie des Forces de défense populaires, aurait eu sous ses ordres des milliers de miliciens/Janjaouid d’août 2003 à mars 2004 environ. M. Abd–Al-Rahmana été transféré à la garde de la Cour le 9 juin 2020, après s’être rendu volontairement en République centrafricaine. Le premier mandat d’arrêt délivré le 27 avril 2007 et le second mandat d’arrêt rendu public le 11 juin à l’encontre de M. Abd–Al-Rahman énumèrent 53 chefs, mettant en cause sa responsabilité pénale individuelle pour des crimes de guerre et des crimes contre l’humanitéprétendument commis au Darfour (Soudan).
Le 15 juin 2020, l’affaire à l’encontre de M. Ali Muhammad Ali Abd-Al-Rahman a été séparée de celle de M. Ahmad Muhammad Harun puisque M. Harun n’a pas encore été remis à la Cour. Cela est fait dans le but de protéger le droit de M. Abd-Al-Rahman à une procédure équitable et rapide et dans l’intérêt de l’économie judiciaire.
