المجموعة السودانية للحقوق (حقوق): تقرير عن وضع حقوق الانسان في السودان (1 أكتوبر / 31 أكتوبر)

 

تطورات جديده:

· كشف المدعي العام لجرائم دارفور في تصريح صحفي لقناة الشروق الموالية للنظام في 17 أكتوبر 2016 أن أعضاء من الجيش و القوات النظامية المختلفة متورطون في جرائم في إقليم دارفور و كانوا يتصرفون وفق دوافعهم الشخصية، و ذكر بأن مكتب جرائم دارفور استطاع ان يرفع الحصانة عن قرابة 50 شخص من الجيش و القوات النظامية و هم الان امام المحاكم المختلفة.

· في يوم 16 أكتوبر 2016 بدأ المدعي العام في مدينة بورتسودان بالتحقيق في حادثة قتل 20 متظاه و ذلك في يانير 2005، و لقد كان هذا التحقيق نتيجة قرار من المحكمة الدستورية صدر في يوليو 2015 و لقد لغي قرار المحكمة الدستورية كل قرارات المحاكم السابقة التي صدرت ضد اسر القتلى الذين طالبوا بالتحقيق، بالأضافة إلى ذلك وجهت المحكمة المدعي العام بالتحقيق في هذه الحادثة و توجيه الإتهام للجناه. خلفية تاريخية عن القضية:

في 28 و 29 يانير 2005 قامت قوات الشرطة و جهاز الأمن و المخابرات الوطني و الجيش بإستخدام العنف المفرط حيث قامت بإطلاق الاعيرة النارية و الغاز المسيل للدموع بإتجاه المتظاهرين و أدى ذلك لمقتل أكثر من 20 شخص و اصابة 50 اخرون، وقعت هذه الحادثة بعد سلسلة من التظاهرات التي نظمتها مجموعة من الشباب الذين كانوا ينون تسليم مذكرة تحتوي على مجموعة من المطالب لحاكم ولاية البحر الأحمر، و تشمل المطالب إتاحة فرص عمل و تقسيم عائدات مناجم الذهب و الموانئ البحرية الولاية لخدمة الولاية. أغلبية المتظاهرن كانوا من قبائل البجا.

خلال التظاهرات و نتيجة للعنف المفرط الذي تم إستخدامه من قبل القوات النظامية ضد المتظاهرين قام بعض المتظاهرون بالرد بعنف. هذا و قد بدأت السلطات تحقيق في هذه الاحداث يوم 29 يانير 2011 و في 28 فبراير 2005 قامت وزارة الداخلية بتشكيل لجنة للتحقيق في هذه الحادثة، هذا و لم يتم نشر نتائج تحقيق هذه اللجنه للرأي العام ولا حتى لأسر الضحايا، و بدلاً عن ذلك قامت اللجنة بالتوصل لتسوية مع بعض اسر الضحايا، هذا و رفض عدد من اسر القتلى استلام الديات التي قامت بدفعها الحكومة و يطالبون بمحاكمة الجناة، و وفقاً لعريضة قام بتسليمها اهالي القتلى

كما قامت الاسر كذلك بتسليم عريضة للمدعي العام تطالبه بالبدأ في الاجراءات القانونية ضد القوات المتورطة في قتل ذويهم، هذا و رفض المدعي العام العريضة و قد استأنف الشاكون أكثر من مره و قاموا برفع عرائض للمدعي العام و النائب العام اكثر من مره، و لكن لم يقم اي تحقيق جنائي في هذه الاحداث. في 2013 قام الشاكون بالإستئناف في المحكمة الدستورية و التي اصدرت قرارها المذكور اعلاه في يوم 7/7/2015. و على الرغم من أن المحمكة الدستورية أصدرت قرار يسمح للشاكين بالبدأ في الاجراءات القانونية إلا ان هنالك الكثير من العقبات التي وقفت امامهم لتحقيق العدالة، فمثلاً المدعي العام رفض ضم ملف لجنة التحقيق و نتائجها لملف القضية.

في 8 اكتوبر 2016 قام وزير التعاون الدولي كمال حسن علي بالإعلان خلال اجتماع للجنة العلاقات الدولية في المجلس الوطني بأن الحكومة السودانية تطبق طلبات جديدة متعلقة بالتمويل الاجنبي، حيث تمنع التمويل المباشر للمجتمع المدني السوداني و المنظمات الغير الحكومية إلا من خلال وزارة الخارجية، مضيفاً بأن اي مشاريع مموله يجب ان تتوافق مع احتياجات و اوليات السودان و ليس المانحين. كما اضاف ايضاً بأن هنالك حاجة لمراقبة التمويل الاجنبي و صرفه في السودان لأنه نوع من انواع التدخل في الشؤون الداخلية للسودان و يعد خرق للسيادة الوطنية(2).

في 3 اكتوبر 2016 رفضت هيئة علماء السودان التعديلات الجديدة على القانون الجنائي لعام 1991، و لقد طالبت الهيئة المجلس الوطني للخضوع لقوانيين الله في مواجهة هذه التعديلات الجديده على القانون، و التي شملت تغيير عقوبة الرجم للمتزوج الذي يمارس علاقة جنسية خارجة الزواج إى الأعدام شنقاً، حيث ذكرت الهيئة ان هذا الامر يتعارض مع النصوص و القوانيين الاسلامية.

في 3 اكتوبر 2016 قامت وزيرة الاتصالات تهاني عبد الله بالكشف عن أن وزارة الاتصالات تعمل على تقديم تعديلات جديدة على قانون مكافحة الجريمة المعلوماتية لعام 2007، و قد اشارت ايضاً خلال المناقشات داخل المجلس الوطني يوم 3 اكتوبر بأن التعديلات الجديده على القانون تشمل عدة تحديثات فبالإضافة لتناول التعديلات لإستخدام الاطفال هنالك جرائم اخرى لها علاقة بالامن القومي، و قد اخطرت الوزيرة البرلمان بأن التعديلات الجديده على القانون تشمل عقوبات رادعه لبعض الجرائم حيث يصل بعضها للسجن عشرة اعوام (3) .

حرية التعبير:

· في 20 اكتوبر 2016 ذكر الصحفي عادل ابراهيم (كولر) و هو صحفي بصحيفة الايام اليومية، بأنه تم استدعاءه و التحقيق معه من قبل جهاز الامن و المخابرات الوطني، كان استاذ عادل في في محكمة الخرطوم شمال الجنائية يغطي محاكمة ناشطين في حقوق الانسان يعملون لدى مركز تراكس (TRACKS). و اثناء تواجده داخل قاعة المحكمة قام ضابط امن بسؤاله عن اسباب تواجده داخل القاعه فذكر له بأنه صحفي و قام ضابط جهاز الامن بأخذ بطاقته الصحفية و طلب منه بأن يأتي لمركز الشرطة للحصول عليها. · في 20 اكتوبر 2016، قامت المصنفات الادبية بمصادرة و منع عدد من الكتب في معرض الخرطوم الدولي للكتاب، و من ضمن الكتب التي قامت بمصادرتها: الحب في زمن الكوليرا لغبرييل غارثيا ماركيث، الجنازير المقدسه لعبد الله الأسد و كذلك تمت مصادرة كتاب للروائية الجنوب سودانية ستيلا قايتانو و هي رواية للأطفال و لقد اخبرت السلطات الناشر بأن يأخذ الرواية لجوبا. · في 18 اكتوبر 2016، صادر جهاز الامن و المخابرات الوطني صحيفة الجريدة اليومية من المطبعة و ذلك بعد طباعتها، و وفقاً لمدير التحرير أشرف عبد العزيز فلقد أخبر حقوق بأن جهاز الأمن و المخابرات الوطني ذكر له بأن المصادرة تمت نتيجة لنشر مقال لكتاب الاعمده عثمان شبونا عن استخدام الاسلحة الكيميائية في دارفور من قبل الحكومة و التي قامت الصحيفة بنشرها. · في 17 اكتوبر 2016 قامت نيابة الصحافة و المطبوعات بالتحقيق مع الصحفية هنادي الصديق الصحفية بصحيفة الجريدة و ذلك على خلفية مقالتين كتبتهما الصحفية، فلقد تقدم المدعي العام عبد الرحيم الخير الذي يمثل الحكومة في قضية مقتل الطالب عاصم عمر و هو طالب تم اتهامه بقتل شرطي اثناء احداث جامعة الخرطوم في ابريل الماضي، حيث كتبت في مقال لها الصحفية هنادي الصديق في عمودها الثابت في صحيفة الجريدة الذي يحمل اسم (بلا حدود) عن فشل النظام القضائي في السودان حيث تحدثت عن ان المدعي العام كان يملي على الشهود ما يقولون في المحكمة و لقد حمل العمود عنوان (فضيحة المدعي العام)، هذا و لقد كانت الشكوى الثانية التي قدمت لنيابة الصحافة و المطبوعات بشأنها قدمت من ناصر ابو القاسم و هو رئيس حزب المؤتمر الوطني في منطقة الجريف و عضو المجلس التشريعي لولاية الخرطوم، حيث نشرت الصحفية مقال عن مصادرة الاراضي في منطقة الجريف. · في 12 أكتوبر 2016، قام جهاز الامن و المخابرات الوطني بإعتقال الصحفي امير ياسين و هو صحفي في صحيفة الرأي العام اليومية، قام جهاز الامن بالتحقيق معه لعدة ساعات بخصوص تقرير صحفي عن وجود مواد مسرطنة و نفايات جنوبي الخرطوم، تم اطلاق سراح امير ياسين في نفس اليوم دون توجيه اتهامات له. · في 9 اكتوبر 2016 قام جهاز الامن و المخابرات الوطني بمصادرة النسخة المطبوعه من صحيفة الوطن و ذلك من المطبعة و دون ابداء الاسباب. ( المصدر: جهر السودان)

· في 8 اكتوبر 2016 قام جهاز الامن و المخابرات الوطني بإستدعاء الصحفية شذى الشيخ الصحفية بصحيفة الجريدة، و قام جهاز الامن بالتحقيق معها لمدة ثلاث ساعات بخصوص تقرير صحفي لها نشر في الجريدة يتحدث عن الفساد المحيط بموضوع الاراضي في محلية المناقل في ولاية الجزيرة. ذكرت الصحفية شذى لحقوق بأن ضابط جهاز الامن الذي حقق معها أمرها بأن تكشف عن مصادر المعلومات التي نشرتها. و في 9 اكتوبر قام جهاز الامن و المخابرات الوطني بإستدعاء مصدر المعلومات و أمره بأن يقوم بالحضور بشكل يومي لمكاتب جهاز الامن. حرية التجمع :

· في 21 اكتوبر 2016 قام جهاز الامن و المخابرات الوطني في مدينة بربر في ولاية نهر النيل بإقتحام دار الحزب الشيوعي السوداني و ألغى الفعالية التي كان مزمع اقابلتها من قبل الحزب للإحتفال بالذكرى ال52 لثورة اكتوبر و ال70 لتأسيس الحزب الشيوعي السوداني، على الرغم من ان الحزب كان قد تحصل على الموافقات الرسمية المطلوبة من قبل السلطات، هذا و قرر المنظمون للفعالية الاستمرار في الفعالية كما هو مقرر لها و في حوالي الساعه 5:30 مساءً حضر افراد جهاز الامن و المخابرات الوطني في اربع سيارات (بيك اب) و مدججين بالاسلحة و معهم شرطة فض الشغب، و قاموا بتفريق الحضور بالقوة و اغلقوا دار الحزب الشيوعي السوداني. · في 23 اكتوبر 2016 قام سكان حي الجريف شرق في الخرطوم بتنظيم اعتصام، حيث شهدت المنطقة اغلاق للمحلات و المدارس و السوق إحتجاجاً على تعدي السلطات على اراضيهم و بيعها للمستثمرين و مصادرة الاراضي الزراعية و اماكن تصنيع الطوب (الكمائن).

و في 24 اكتوبر 2016 قامت 38 شاحنه تابعة للشرطة و 20 عربة شرطة (بيك اب) بمهاجمة مكان تجمع المحتجين و اعتصامهم و هاجموا المعتصمين بالغاز المسيل للدموع الذي ضربوه على خيم المعتصمين كما تم إستخدام الأعيرة المطاطية و ضرب الرصاص الحي في الهواء لتفريق المتظاهرين، و اقتحمت القوات خيام المعتصمين و قامت بمصادرة اجهزة الصوت (الساوند) و قاموا بتكسير بعض الكراسي و وفقاً لشاهد عيان أخبر حقوق بأن الاشتباكات اصبحت عنيفة بين المتظاهرين و الشرطة مما دفع الشرطة للإنسحاب من المنطقة و تمركز بالقرب من كبري المنشية بالقرب من مستشفى شرق النيل، في 25 اكتوبر قامت قوة في ملابس مدنية مكونة من 65 عربة (بيك اب) حاولت اقتحام المنطقة و لقد استخدمت هذه القوة الغاز المسيل للدموع و قامت بإلقائه على المنازل و قاموا ايضاً بإطلاق الاعيرة النارية مما أدى لإصابة خمسة اشخاص من بينهم اثنين مصابين بأعيرة نارية، كما قام جهاز الأمن و المخابرات الوطني بإعتقال ثلاثة اشخاص من اعضاء لجنة إعتصام الجريف شرق، و تم اخذهم لقسم شرطة حلة كوكو و من بعدها تم تحويلهم لمكاتب الأمن السياسي في جهاز الأمن و المخابرات الوطني في بحري بالقرب من موقف باصات شندي، في 26 اكتوبر قامت قوات من جهاز الامن و المخابرات الوطني مدعومة بقوات من الشرطة بمحاولة إقتحام المنطقة للمرة الثالثة ، و لقد استخدمت القوات الكلاب البوليسية في مضاردة المحتجين و استخدمت القوات الغاز المسيل للدموع بكميات كبيرة جداً مما أدى لعدد من حالات الاختناق، و افاد شاهد عيان لحقوق بأن القوات ما زالت تحاصر المنطقة، هذا و لم يتمكن فريق حقوق من التحصل على اسامي المصابين. · في 23 اكتوبر 2016 و في حوالي الساعه 1:30 ظهراً قامت قوات الشرطة الجامعية المشكلة حديثاً بإعتقال عبد الله ادم محمد ادريس (بولاد) 26 عام و طالب في جامعة شرق النيل كلية الاقتصاد المستوى الثالث، حيث كان ينوي حضور منتدى رابطة طلاب دارفور في الجامعه، قامت الشرطة بإعتقال بولاد من داخل جامعة الخرطوم بالقرب من بوابة النشاط، و بعد ذلك تم أخذه لمكتب الحرس الجامعي دون سؤاله عن بطاقته الجامعيه، و بعد تفتيشه في مكتب الحرس الجامعي تم العثور معه على بطاقة لأحد طلاب جامعه الخرطوم و قامت الشرطة الجامعية بعدها بتسليمه لأحد عناصر جهاز الأمن و المخابرات الوطني و الذي قام بأخذه لقسم شرطة الخرطوم شمال، و في قسم الشرطة تعرض بولاد للإهانات من قبل افراد من الشرطة و جهاز الامن و المخابرات الوطني حيث تم استخدام ألفاظ عنصرية تجاهه و تمت معاملته بصورة مهينه،و تم توجيه اتهامات له بإنتحال الشخصية تحت الماده (113) من القانون الجنائي 1991، و تم اطلاق سراحه بعدها بالضمانه. الاعتقال التعسفي و الاحتجاز:

· في 20 اكتوبر 2016 و في حوالي الساعه 4:00 مساءً قامت قوات من جهاز الأمن و المخابرات الوطني في مدينة بربر في ولاية نهر النيل بإعتقال عادل السيد 45 عام و الفاضل جعفر 40 عام و اسامه عبد المونعم 22 عام، تم إعتقالهم عندما كانوا يجوبون المدينة يعلنون عن ندوه للحزب الشيوعي السوداني، تم التحقيق معهم لمدة ساعتين و تم اطلاق سراحهم بعدها دون توجيه اتهامات. · في 21 اكتوبر 2016، قام جهاز الامن و المخابرات الوطني في مدينة بربر في ولاية نهر النيل بإعتقال عثمات تاج السر و السر علي الحسن من الشارع بالقرب من مقر الحزب الشيوعي السوداني في مدينة بربر و ذلك بعد ان قام جهاز الامن و المخابرات الوطني بإقتحام مقر الحزب الشيوعي، هذا و لقد قام جهاز الامن بالتحقيق معهم لمدة ساعتين و وفقاً لشهادة احد اعضاء الحزب الشيوعي لحقوق فإن المعتقلان تعرضا للضرب و التعذيب، و نتيجة لضرب السر علي الحسن تعرض لاصابة بالغة في الاذن، هذا و لقد تم اطلاق سراحهما في نفس اليوم و دون توجيه اتهامات. · في 18 اكتوبر 2016 و حوالي الساعه 3:30 ظهراً قامت قوات جهاز الامن و المخابرات الوطني بإعتقال محمود عبدو مصطفى 62 عام و هو عضو الحزب الشيوعي السوداني، و تم إعتقاله من منزله في حي الدروشاب في مدينة بحري ولاية الخرطوم، و وفقا لإفادته لحقوق فإنه في حوالي الساعه 3:30 ظهراً طرق أحدهم باب منزله و سأل عنه و عندما حضرت سأل إذا ما كان المنزل للإجار و عندها أتت عربة (بوكس دبل كبين) مظلله و عليها أربعة أشخاص في ملابس مدنية و كانوا يحملون أسلحة نارية و سألهم عن هويتهم، و قالوا له إنهم جهاز الأمن و المخابرات الوطني و نريدك أن تأتي معنا، وبعدها طلبو مني ان اذهب معهم الي مكان قريب وعندما سالت عنه تم اخباري بانني ساعرف حالما اصل وعندما سالت عن من هم اجابوا (نحن جهاز الامن ودايرنك دقيايق وبنرجعك ) وطلبوا مني ان ارتدي ملابسي لانني كنت ارتدي (عراقي وسروال ) اخبروني بانني ساتي قريبا .

تحركوا بي الي موقع جهاز الامن بحلة حمد بالقرب من المقابر وعندما وصلنا تم التحقيق معي من قبل ٣ افراد واخر يرتدي زي عسكري بدون علامات ( تحديد الرتبة ) وبدا التحري الاولي حوالي الساعة التاسعة مساء وبعدها اخبروني بانني سادخل تحقيق مع اخر اعلي منهم رتبة حال وصولة , بداء التحقيق الثاني الساعة ١١ عن انني اقوم بتوزيع المنشورات وانني انسق للجان مقاومة.

وبعد انتهاء التحقيق امرهم بترحيلي الي مكاتب الامن السياسي الا ان تدخل احدهم وطلب اطلاق سراحي علي ان اعاود الحضور صباحا بحجة انني كبير في السن وبالفعل تم اطلاق سراحي ولم اذهب لهم في اليوم التالي ولكنهم ظلوا يتصلون بي هاتفيا وذهبت لهم في يوم ٢٠ وعندها اخبروني بان اذهب الي مكتب اخر للمتابعة معي ويقع في (غرب الطربمة بشارع الانقاذ بحري ) ولم اذهب فظلوا يراقبونني بالمواتر وياتون الي منزلي من وقت لاخر .

مقتل طالب:

· في 23 اكتوبر 2016 و في حوالي الساعه 10:30 مساءً وجد الطالب ادم يحي هارون 24 عام قتيلاً و هو طالب في جامعة السودان للعلوم و التكنولوجيا في المستوى الثالث كلية تقنية المعلومات، يسكن داخلية طلاب جامعة امدرمان الاسلامية في منطقة الشقلة في امدرمان، و عنوانه معسكر كلمه للنازحين في محلية بليل في ولاية جنوب دارفور، و لقد وجد قتيلاً من قبل احد طلاب الصيدلة في جامعة امدرمان الاسلامية بالقرب من مقر اتحاد الطلاب، و وفقاً لشهادة الطالب الذي عثر على جثة القتيل فإنه لقد لاحظ علامات تعذيب على كتف و رقبة القتيل، وقام بعدها بحمل القتيل إلى الداخلية و عند بوابة الداخلية إلتقى هنالك بأربعه اشخاص في ملابس مدنية و على عربة (بيك اب) قاموا بأخذ الجثه منه و أخبروه بأنهم سوف يأخذون المتوفي إلى مستشفى السلاح الطبي، هذا و لقد اخبر ابن عم المتوفي حقوق بأنهم تلقوا مكالمه من شخص غريب يخبرهم بأن يذهبوا للمستشفى لإستلام جثة القتيل، و وفقاً لإفادة احد طلاب دارفور لحقوق فإن شهادة الوفاة التي صدرت من مستشفى السلاح الطبي كتب فيها بأن القتيل تعرض لضربات شديدة على الرقبة و اجزاء اخرى من جسده،، و تم نقل الجثة بعدها لمستشفى امدرمان التعليمي عن طريق افراد في جهاز الامن و المخابرات الوطني حيث تحصلوا من مشرحة المستشفى على شهادة وفاة اخرى تذكر بأن الوفاة حدثت نتيجة صعقة كهربائية. هذا و أستلمت اسرة القتيل الجثة عن طريق نفس الاربعة اشخاص الذين قاموا بنقله من الداخلية لمستشفى السلاح الطبي و اختفوا بعدها. ( فريق حقوق حاول الاتصال بعم القتيل و لكنه رفض الحديث و اعطاء اي معلومات و اخبر فريق حقوق بأن جهاز الامن و المخابرات الوطني أخبره بأن لا يتحدث عن مقتل هارون مع اي احد و إلا واجه مشاكل و لقد اخبر فريق حقوق بأن هاتفه مراقب و قام بعدها بإغلاق الهاتف)

سياق القضية:

في 19 اكتوبر 2016 قامت الوحدة الطلابية في جامعة امدرمان الاسلامية بتنظيم مخاطبة سياسية و تسليم مذكره لصندوق دعم الطلاب، مطالبين بفتح داخليات الطلبه التي تم اغلاقها خلال تظاهرات ابريل الماضي، و لاحقاً في نفس اليوم قام مجموعة من الطلاب الموالين لحزب المؤتمر الوطني بمهاجمة داخلية طلاب صيدلة و قاموا بإستجواب اثنين من الطلاب الذان كانا من منظمي و قيادات المخاطبة، و لقد وجدوا ادم يحي هارور و ضربوه. في 20 اكتوبر قام الطلاب بفتح الداخلية و لم يجدوا هنالك كهرباء او مياه فيها و قامت قوات جهاز الامن و المخابرات الوطني بمحاصرة الداخلية. (حسبما افاد طالب في الجامعة فإنهم يشكون بأن هارون قتل، هذا و لم يتمكن فريق حقوق من التحصل على مزيد من المعلومات)

قانون النظام العام:

· في 18 اكتوبر 2016، قامت قوات الشرطة بإقتحام مخيم كيرو للاجئين الجنوب سودانيين جنوب محلية الضعين في ولاية شرق دارفور، حيث قامت الشرطة بشن حملة ضد الخمور البلدية، و ذكر شاهد عيان من المخيم لحقوق ” قوات الشرطة اقتحمت المخيم بشاحنات بقيادة ملازم اول حوالي الساعه 12:00 منتصف الليل، و هذا المخيم يحتوي على 3200 لاجئ من جنوب السودان و إندلعت اشتباكات بين الشرطة و اللاجئين، و قامت الشرطة بإستخدام الهراوات في ضرب اللاجئين، و نتيجة لهذا اصيب عدد من اللاجئين منهم دوت باك و الذي تعرضت لإصابة بالغة بعد ان قام شرطي بضربها على رأسها بعقب بندقية، و تم نقلها بعد ذلك لمستشفى الضعين لتلقي العلاج هذا و لقد اعتقلت الشرطة قرابة ال15 لاجئ خلال هذه الحملة.

في صباح يوم 19 اكتوبر 2016 قامت قوات الشرطة و معها ما يعتقد انهم افراد من جهاز الامن و المخابرات الوطني في زي مدني بإعتقال القيادي المجتمعي ابراهيم أويل دينق 55 عام من مستشفى الضعين و ذلك اثناء زيارته للمصابين في المستشفى، و تم اخذه جنوبي السوق الكبير و تم إحتجازه مع عدد من الاشخاص في قسم الشرطة هنالك و المعتقلين في هذه الاحداث هم :

1- ماركو لينو واليت، 34 عام.

2- ربيكا جيمس تاسوير، 46 عام.

3- قرنق شوات اجوت، 37 عام.

4- ألوت وت باك، 32 عام.

5- الوت دينق واو، 34 عام.

6- شريف ابراهيم ويل، 24 عام.

7- مارك دينق دينق، 30 عام.

8- جوزيف نيوك ألاو، 24 عام.

· في 20 اكتوبر 2016 قام القاضي في محكمة النظام العام في مدينة الضعين محمد خضر بالحكم على المعتقلين بإعتراض عمل موظف عام اثناء أداء عمله تحت الماده (99) و الإرهاب تحت الماده (144) من القانون الجنائي 1991، هذا و تم الحكم على المعتقلين بالجلد 40 جلده و السجن ثلاث شهور و دفع غرابة قدرها 5000 جنيه لكل واحد منهم ما عدا ابراهيم اويل دينق و ربيكا جيميس. الإستخدام المفرط للعنف:

قرية كوكري في ولاية سنار:

· في 23 اكتوبر 2016 و حوالي الساعه 8:00 صباحاً قتل يوسف مالك علي 38 عام و هو مزارع في قرية قوقري ابو حجار في محلية شرق المزموم في ولاية سنار و التي تبعد 20 كيلوميتر عن الحدود مع جنوب السودان، و لقد قتل نتيجة اصابته بطلق ناري في الصدر و دهسه من قبل عربة شرطة، هذا و قد هاجمت قوات الإحتياطي المركزي (المعروفة بإسم أبو طيرة) المزارع يوسف مالك علي بينما كان يقوم بحصاد السمسم في مزرعته، هذا و قد امرت قوات الشرطة يوسف بالتوقف عن الحصاد و لكنه رفض الانصياع لأوامرهم و هاجم الشرطة التي قامت عندها بقتله و دهسه، افاد احد سكان قرية قوقري لحقوق بأن الشرطة قامت بدهس القتيل بعد اصابته بعيار ناري، و قد ادى هذا الحادث بإشعال إحتجاجات في القرية و لدى قبيلة القتيل هذا و حوالي الساعة 5:30 مساءً بدأت اشتباكات بين المحتجين و الشرطة حيث استخدمت الشرطة الاعيرة النارية و قامت بقتل مواطن اخر من المنطقة و هو الصادق احيمر 22 عام و هو يعمل في الرعي.

· هذا و تمت اصابة اثنين اخرين اصابة بالغة و هما عطا المنان يوسف يعقوب و السماني عبد الرحمن الفاضل و هما مزارعان، و هما الان يتلقيان العلاج في مستشفى ود مدني في ولاية الجزيرة، هذا و قتل 10 افراد من الشرطة خلال هذه الاحتجاجات و تمكن سكان القرية من اخذ اسلحة الشرطة و مضاردتهم خارج القرية هذا و وفقاً لإفادة احد سكان القرية لحقوق فإن السلطات قامت بتكوين لجنة للتحقيق في هذه الاحداث و قاموا بسحب قوات الإحتياطي المركزي و حرق مخيمهم في القرية، هذا و قام أسر الضحايا برفع ثلاث شكاوي ضد الشرطة.

العنف في إقليم دارفور:

· في 26 اكتوبر 2016 و حوالي الساعه 7:00 مساءً في منطقة قارسيلا في محلية وادي صالح في ولاية جنوب دارفور قام خمسة أفراد يمتطون خيولاً من ميليشيا الجنجويد بإطلاق النار و قتل يونس يعقوب عبد المولى، 56 عام و هو مزارع من من مخيم قارسيلا الجبلين للنازحين، هذا و قتل و هو في طريق عودته لمنزله و معه ثلاث من ابنائه (ابنتين و ابن ) ، قام الجنجويد بمهاجمتهم محاولين اغتصاب بناته و قد حاول المتوفي أن يدافع عنهن مستخدماً سكيناً و عندها قام المهاجمون بقتله بطلقة في الصدر، هذا و هرب المعتدون بعدها. · في 24 أكتوبر 2016 قامت قوات من الشرطة و الجيش السوداني الكتيبة 15 التي تتمركز في سربا بقتل حمدان محمد سعيد 41 عام و هو راعي من قرية ابو سروج محلية سربا ولاية غرب دارفور، و ذلك بعد دخوله بجماله ارض المزارع ابكر يحي ابكر الذي اشتكى لشرطة ابو سروج في محلية سربا، مشتكياً من تعدي الراعي على زرعه و طالب بإخراج الجمال من ارضه هذا و اتت السلطات و حاولت اعتقال الراعي و اخراج الجمال من الارض و ادى ذلك لحدوث اشتباك مع حمدان و القوات و قام حمدان بإطلاق عيار ناري على الهواء و عندها قام احد افراد الجيش بقتله بطلقة في الصدر، و تم نقل جثة القتيل إلى مستشفى الجنينه. · في 22 أكتوبر 2016 و حوالي الساعه 2:00 فجراً، قامت مجموعة مسلحة لم يتم التعرف عليها بمهاجمة علي محمد أحمد الزاكي 24 عام في محله في حي المواشي في مدينة نيالا في ولاية جنوب دارفور هذا و قام المعتدون بإطلاق الاعيرة النارية على رجليه و قاموا بنهب المحل.

· في 20 أكتوبر 2016، و حوالي الساعه 5:00 مساءً قامت قوات من جهاز الامن و المخابرات الوطني بإعتقال الفرشه صالح أرباب من منزله في حي الثوره في محلية الجنينه ولاية غرب دارفور، و كان الاعتقال نتيجة زيارة أرباب لمخيم السيسي للنازحين بعد حوادث قتل و اعتداءات متعددة حدثت داخل المخيم من قبل ميليشيات الجنجويد.

· في 20 أكتوبر 2016 و حوالي الساعه 3:00 ظهراً تعرض ضاحي ادم كرامه 38 عام و هو مزارع للهجوم من قبل مجموعة مسلحة من الرعاة يرتدون ملابس عسكرية و مدنية، ادخل الرعاة المسلحون جمالهم لمزرة ضاحي، و عندما حاول ان يبعد الجمال عن مزرعته في منطقة البان جديد في محلية سربا قاموا بإطلاق النار عليه مما ادى لاصابته في كتفه اليمين، و وفقاً لإفادة أحد اقربائه لحقوق فإن ضاحي حاول ان يبعد الجمال عن زرعه و كانت اعدادها كبيرة فقام أحد الرعاة بجلده فحاول ضاحي ان يدافع عن نفسه بفأس كان يحمله فقام أحدهم بإطلاق عيار ناري عليه اصابه في كتفه، و تم نقله إلى مستشفى سربا لتلقي العلاج. · في 13 أكتوبر 2016، قامت بقتل حواء ادم محمد ابكر 50 عام في أزرني في محلية أبو كارينكا في ولاية شرق دارفور بينما كانت تعمل في الحقل.

· في 11 اكتوبر 2016 و حوالي الساعه 5:00 مساءً، تعرض عبد أرباب 43 عام و مقيم في منطقة الشاطئ في محلية بيدا لإطلاق نار بالخطئ من قبل أحد عناصر الجيش السوداني في محلية بيدا في ولاية شرق دارفور و ذلك عندما كانت قوات الجيش تضارد أحد الناس على دراجة نارية في وادي غاندي بالقرب من محلية بيدا، أرباب كان في طريقه للمنزل من المزرعة عندما تعرض لإطلاق نار، و لقد أصيب اصابات بالغة و تم تحويله لمستشفى الجنينه، و توفي يوم 16 أكتوبر 2016 متأثراً بجراحه. · في 9 أكتوبر 2016، قامت مجموعة من ميليشيا الجنجويد بضرب ساره محمد 25 عام و هي أرمله مقيمة في حي الإمتداد في محلية أبو كارينكا ولاية شرق دارفور ، قام المهاجمون بإدخال مواشيهم في مزرعة ساره و عندما عارضتهم و حاولت الدفاع عن مزرعتها قامت الميليشيا بالاعتداء عليها بعنف حيث ضربوها بالعصي و تعرضت لاصابات بالغة، و تم تحويلها بعد ذلك لمستشفى الجنينه لتلقي العلاج.

· في 5 اكتوبر 2016 و حوالي الساعه 9:30 قام احد افراد قوات الدفاع الجوي بالزي الرسمي بإطلاق النار على مجموعة من المواطنيين في سوق حي الجبل في مدينة نيالا ولاية جنوب درافور مما ادى لاصابة امرأة تعاني من خلل عقلي و تعيش في السوق حيث اصيبت في ظهرها، و تعرض كذلك حافظ ادم حسين 41 عام لإصابة في الرأس و حسين ادم الدوم 40 عام تعرض لأصابة في الصدر و ذراعه الايمن و رجله الأيمن، و تم نقلهم جميعاً لمستشفى نيالا و حالتهم حرجه، و في 6 اكتوبر 2016 توفي حافظ ادم حسين في مستشفى نيالا متأثراً بجراحه. · في 4 اكتوبر 2016 قام رجلان مسلحان بإطلاق النار و اصابة مبارك شطه تيتي 29 عام، و محمد اسحاق 24 عام في منطقة شمال الجير في مدينة نيالا ولاية جنوب دارفور، و قامت السلطات بإعتقال أحد المعتدين و لكن تم إطلاق سراحه بعد يومين من قبل عمه الذي يعمل في قوات الدعم السريع. (المصدر فريق حقوق دارفور)

· في 4 أكتوبر 2016 قامت قوات جهاز الأمن و المخابرات الوطني بإعتقال الطالب المرضي مختار 21 عام و هو طالب في المستوى الثالث كلية الطب، و مدر اسحاق ابكر 25 عام و هي طالبة في المستوى السادس كلية الطب، و علي اسماعيل علي 26 عام و هو طالب في المستوى السادس كلية الطب، و جميعهم يدرسون في جامعة الفاشر حيث كانوا يحتجون ضد الرسوم الدراسية المرتفعة، و قامت قوات جهاز الأمن و المخابرات الوطني بأخذهم لقسم شرطة الأوسط و أطلقت الشرطة سراحهم بعد التحقيق معهم في نفس اليوم و دون توجيه اتهامات.

· في 3 أكتوبر 2016 قام أربع أشخاص مسلحون في عربة لاندكروزر لا تحمل لوحات و لم يتم التعرف على الجهة التي يتبعون لها بقتل محمد عبد الكريم 36 عام و ذلك بإطلاق الرصاص عليه، و هو الحارس الشخصي لمعتمد محلية الملم منطقة شرق جبل مره في ولاية جنوب دارفور، كما قتل ايضاً السائق الشخصي للمعتمد الحاج ادم اسحاق 38 عام كما قام المعتدون بسرقة عربة المعتمد الجديده و الفرار بها.

· في 3 أكتوبر 2016، قامت محكمة جنايات الجنينه في ولاية غرب دارفور بالحكم على مبارك عبد الحكم الخير 29 عام، و هو طالب في جامعة الجنينه و ناشط سياسي فيها بسنة سجن و غرامة قدرها 12000 جنيه سوداني و ذلك تحت مادة الجرح العمد (139) من القانون الجنائي السوداني 1991، مبارك كان قد اعتقل في 31/1/2016 عن طريق قوات من جهاز الامن و المخابرات الوطني، و ذلك بعد اجتياح قوات جهاز الامن الجامعه و أحداث العنف التي راح ضحيتها الطالب صلاح قمر، و قد أعتقل مبارك لمدة 11 يوم لدى مكاتب جهاز الأمن و المخابرات الوطني في الجنينه و تعرض خلالها حسبما تشير التقارير للتعذيب، و تم نقله بعدها لمركز شرطة الجنينه في 11/2/2016 و أتهمه جهاز الأمن بطعن أحد افراده، و الازعاج العام و الاخلال بالسلام العام. · في 2 أكتوبر 2016 و حوالي الساعه 2:30 فجراً قامت مجموعة من ستة رجال مسلحون يرتدون الزي العسكري الرسمي و ملثمون (يرتدون ما يعرف بالكمدول) بمهاجمة منزل محمد ادم شرق استاد زالنجي في ولاية وسط دارفور، و يعمل محمد ادم على عربة كارو، هذا و هاجم المعتدون عليه النار و نتيجة لذلك اصيبت ايه محمد ادم 13 عام و اصيب محمد ادم اصابة بالغة و كان في غيبوبة، و تم نقلهما إلى مستشفى زالنجي.

حرية التجمع:

· في 30 أكتوبر 2016، قامت قوات جهاز الأمن و المخابرات الوطني في الخرطوم و مناطق مختلفة في السودان بإعتقال و إستدعاء العديد من أعضاء لجنة إعتصام الأطباء، و لقد تم التحقيق معهم لساعات طويلة و تم إطلاق سراحهم في نفس اليوم بشرط الحضور اليومي لمكاتب جهاز الامن و المخابرات الوطني، و أسماء الذين تم استدعاءهم من الاطباء حسبما افاد المتحدث بإسم لجنة الأطباء هم:

1- حسن كرارك مأمون، يعمل في مستشفى الخرطوم، استدعي لمكاتب جهاز الامن و المخابرات الوطني في مدينة بحري بالقرب من موقف شندي.

2- منتصر عثمان يعمل في مستشفى إبراهيم مالك. ( مكانه مجهول)

3- عمر احمد صالح يعمل في مستشفى مدني، استدعي لمكاتب جهاز الأمن و المخابرات الوطني في مدينة بحري بالقرب من موقف شندي.

4- اسراء الأصم، تعمل في مستشفى امدرمان، استدعيت لمكاتب جهاز الأمن و المخابرات الوطني في أبو عنجه أمدرمان.

5- إحسان فقيري، تعمل في مستشفى أمدرمان تم استدعاؤها لمكاتب جهاز الأمن و المخابرات الوطني في أبو عنجه أمدرمان.

6- عبد الله قرشي، يعمل في مستشفى امدرمان تم إستعداؤه لمكاتب جهاز الأمن و المخابرات الوطني في ابو عنجه أمدرمان.

7- محمد عبد اللطيف، يعمل في مستشفى بحري، تم استعداؤه لمكاتب جهاز الامن و المخابرات الوطني في حلة حمد في بحري.

8- هديل (لم يتم التحصل على اسمها بالكامل) تعمل في مستشفى بحري، تم استدعاؤها لمكاتب جهاز الامن و المخابرات الوطني في حلة حمد بحري.

9- خالد الفاتح يعمل في مستشفى بحري، تم استدعاؤه من لمكاتب جهاز الامن و المخابرات الوطني بالقرب من موقف شندي في بحري.

10- عماد الخليفة، يعمل في مستشفى ابراهيم مالك، تم إستدعاؤه لمكاتب جهاز الامن في العمارات شارع 57 في الخرطوم.

11- محمد الهلالي، يعمل في مستشفى ابراهيم مالك، تم إستدعؤه لمكاتب جهاز الأمن و المخابرات الوطني في العمارات شارع 57 الخرطوم.

12- ايمان النعيم، تعمل في مستشفى الشعب، تم استعداؤها لمكاتب جهاز الأمن و المخابرات الوطني في العمارات شارع 57 الخرطوم.

13- محمد المجتبى، يعمل في مستشفى عطبرة، تم استدعاؤه لمكاتب جهاز الأمن و المخابرات الوطني في مدينة عطبرة ولاية نهر النيل.

14- أحمد مصدق، يعمل في مستشفى بورتسودان تم إستدعاؤه لمكاتب جهاز الأمن و المخابرات الوطني في بورتسودان ولاية البحر الاحمر.

خلفية الأحداث:

· في 6 أكتوبر 2016 أعلنت اللجنة المركزية للأطباء عن إضراب عام في كل البلاد، مطالبين بتحسين المجال الصحي في السودان، في 13 اكتوبر أوقف الاطباء الاعتصام لمدة أسبوع بعد اللقاء مع نائب رئيس الجمهورية حسبو محمد عبد الرحمن و وزير الصحة بحر ابو قرده، و قد وافقت الحكومة على الاستجابة لطلبات الأطباء، هذا و أعلنت لجنة الأطباء عن عدم إلتزام الحكومة لما هو متفق عليه، حيث لم تعطل القرارات التعسفية التي صدرت بحق الاطباء خلال فترة الاعتصام، و لم توفر الاجهزة الضرورية للمستشفيات خاصة في الولايات المختلفة.

حرية الاعتقاد و إستهداف المسيحيين:

· في 14 اكتوبر 2016 و حوالي الساعه 12:30 فجراً قامت قوات الشرطة في ود مدني ولاية الجزيرة بإعتقال 9 أعضاء في الكنيسة الإنجيلية و لقد تم توجيه عدد من الاتهامات لهم تحت المواد (77) الازعاج العام و (67) جرائم متعلقة بالطمأنينة العامه و كذلك الشغب و التعدي الجنائي من القانون الجنائي 1991، هذا و لقد تم اطلاق سراح المعتقلين في نفس اليوم أربعة منهم تم إطلاق سراحهم بالضمانه و البقية بعد دفع غرامة قدرها 6000 جنيه سوداني.

· وفقاً لافادة عضو في الكنيسة الانجيلية لفريق حقوق فإنه أخبر حقوق بأن اسباب الاعتقال تعود ليوم الثلاثاء 13/10/2016 حيث قام بعض المعترضون على نظام الإنتخاب داخل الكنيسة و الذين تم تعينهم من قبل وزارة الأوقاف بمهاجمة مبنى مدرسة الكنيسة الانجيلية في ود مدني ولاية الجزيرة، هذا و لقد تقدمت الكنيسة بعريضتين للسلطات ترفض فيهما التعينات الجديده، هذا و لقد حكمت المحكمة لصالح الإستئناف، و في حوالي الساعه 2:00 ظهراً قامت المجموعة المعينة من قبل الوزارة بإحتلال مبنى المدرسة بمساعدة ناس لا يتبعون للديانة المسيحية في مدينة ود مدني، و ذهبت لمبنى شرطة الأوسط في ود مدني و شكوتهم هذا و رفض ضابط الشرطة في القسم شكواي او حتى تنفيذ قرار المحكمة و اخراجهم من مباني المدرسة، و في حوالي الساعه 12:30 ظهراً قام اعضاء الكنيسة الانجيلية بالذهاب لمباني الكنيسة و الاشتباك مع هذه المجموعة المعينه هذا و اتت الشرطة و اعتقلت 9 من اعضاء الكنيسة و هم :

1- صموئيل سليمان ( كاهن و مدير المدرسة)

2- زكريا إسماعيل (كاهن)

3- مكرم بوري (عضو في الكنيسة)

4- الشازلي جمعه (عضو في الكنيسة)

5- جينور (شماس في الكنيسة الانجيلية)

6- سالم ( شماس في الكنيسة الانجيلية)

7- عبد المسيح (عضو في الكنيسه)

8- كودي (عضو في الكنيسة

9- مشيره موسى بابكر (مراسله)

حق العمل:

· في 26 سبتمبر 2016، قام مدير إدارة المخالفات في محلية الخرطوم بإصادر قرار بمنع العاملات في مجال الشاي (ستات الشاي) في المنطقة المحيطة بالساحة الخضراء من العمل لمدة 15 يوم و ذلك لإنعقاد جلسات الحوار الوطني و الاحتفالات المصاحبة للحوار التي اقيمت في الساحة الخضراء و ذلك للحفاظ على المظهر الحضاري في المنطقة المحيطة. رضخت العاملات في مجال الشاي لهذا القرار و لكن بعد ان عادوا إلى اماكن عملهن بعد اسبوعين وجدن المنطقة محاصرة بعربات الشرطة و عدد من رجال الشرطة و المحلية. و ذكر موظف المحلية لهن بأنه غير مسموح لهن بالعمل في هذه المنطقة، و أي سيدة تقوم بمخالفة القرار سيتم مصادرة ادوات عملها من قبل السلطات، هذا و يعتبر هذا العمل هو العمل الأساسي لمعظم السيدات الذي يقمن من خلاله بالصرف على افراد اسرهم.

New Developments:
On the 17th of October 2016, special Prosecutor for Darfur crimes Al-Fatih Issa Tayfour, revealed in a press statement to the pro-government news agency Al-Shrouooq, that members of the military and other forces personnel were involved in committing crimes in Darfur region and were acting in their personal capacities, explaining that his office has lifted the immunity of approximately 50 members of the military and other official forces and currently on trial before different courts1.
On the 16th of October2016, the general prosecutor in Port Sudan – Red Sea state initiated legal investigation in the killing of more than 20 people during demonstrations in Port Sudan in January 2005; the step was a result of the constitutional court decision issued in July 2015 the court decision has canceled all the general prosecutor decisions issued against the victims’ families demands to investigate the case, in addition the court instructed the general prosecutor to investigate the killings incident and to file a criminal case in accordance to the investigations results against the perpetrators. Case Background:
On 28 and 29 January 2005, the police, National Intelligence and Security Service (NISS) and army forces used excessive force by firing tear gas and live ammunition against protesters in Port-Sudan Eastern

Sudan, that resulted in the killing of more than 20 people and injury of more than 50 people, the incident of the killing followed a series of protests organized by group of youth who intended to hand over a list of demands to the governor of the Red Sea state, including employment and share of the wealth produced from the gold mines and seaport. The majority of the protesters were from Beja tribe. During the demonstrations some protesters became violent in response to the use of the excessive force by the police and other forces. on 29/January 2005 the authorities initiated legal procedures, on 27/February 2005 the Minister of Interior has formed a committee of inquiry to investigate the incident, the committee had not made the investigations outcome to the public nor to the victims’ families, instead of that the committee reached a settlement with some of the victims’ families who accepted the blood money (Dia) which was paid by the government, number of the families refused to receive the blood money and demanded the authorities to bring the perpetrators to justice, accordingly the families submitted a petition to the general prosecutor to begin the legal procedures against the forces involved in the killings, the general prosecutor rejected the petition the complainants appealed the prosecutor decision, where they filed several complaints with the prosecutor and public prosecutor, but no criminal investigation was ever conducted. In 2013 the complainants appealed to the constitutional court which issued its decision on 7/7/2015 above. According to the victims lawyer she told Huqooq regardless of the constitutional court decision still there are many obstacles on the way to achieve justice.
On the 8th of October 2016, the International Cooperation Minister Kamal Hassan Ali, announced during a meeting with the parliamentarian committee of foreign affairs that the government of Sudan will enforce new requirements regarding the foreign funding by banning any direct funding to civil society and non-governmental organizations, except through the Ministry of External Cooperation, adding that any funded project should be in accordance with Sudan needs and priorities and not of the donors. He further noted that there is a need to monitor the foreign funding and its spending as it is a form of interference in Sudan internal affairs and violates the national sovereignty2.
On the 3rd of October 2016, Sudan Scholars Association rejected the new amendments to the Criminal Law of1991 for the year 2016, and called on the parliament to abide by the laws of God and reject the recent amendments to the Criminal Law, including the changes of the punishment of adultery crime of a married person from stoning to hanging, confirming that such amendments are contradicting with the standard texts stipulated in the Islamic law.
On the 3rd of October 2016, the Minister of Communications Mrs. Tahani Abd Allah revealed that the ministry of Communications is in the process of submitting new amendments to the Combating Informatics crime law of 2007 for the year 2016 to the Parliament, she further pointed out during a discussion at the parliament on 3/10 that the new amendments to the law includes several updates in order to accommodate the new developments in the technology and the methods of commission of the crimes, the use of children and other crimes related to the national security, the minister informed the

Parliament that the new amendments to the law will carry harsh punishments for number of offences that are punishable with imprisonment exceeding 10 years3.
Freedom of expression:
• On the 20th of October 2016, Adil Ibrahim (Color) a journalist at Alayam Daily Newspaper, was summoned and interrogated by National Intelligence and Security officer, Mr. Ibrahim was at Khartoum North criminal court covering the trial of human rights activists working with the Khartoum-based Centre for Training and Human Development (TRACKS). Whilst inside the court room, a security officer approached him and asked him to disclose the capacity in which he is in the courtroom, and when he told him he is a journalist the NISS member seized Ibrahim’s press card and ordered him to come to the police station after the hearing to receive it.( Source: HR Journalist) • On the 20th and 23rd of October 2016, the Authorities of Literary Work in Khartoum has confiscated and banned number of books from Khartoum International Books Fair in Khartoum, among the confiscated books the famous book of Gabriel Garcia Marquez Love in the Time of Cholera, the Holy Tracks novel by the Sudanese writer Abd-Allah Alasad, South Sudanese novel (grew up all her life in Sudan) by Mrs. Stella Gitano, the book is novel for children the authorities told the publisher to take the book back to Juba and other books by the Sudanese writer Abd Al-aziz Baraka sakin. • On the 18th of October 2016, National Intelligence and Security Service (NISS) confiscated the printed daily newspaper Al-Jareeda from the print house; the Chief Editor of Al-Jareeda newspaper Asharaf Abd Alaziz, told Huqooq that the NISS informed him the reason of the confiscation was an article written by the paper column writer Osman Shabona on the use of chemical weapons in Darfur by the government and published by the paper on 17/10/2016. • On the 17th of October 2016, the press and publication prosecutor interrogated journalist, Hanadi Al-Sideeq, of the printed daily newspaper Al-Jareeda regarding two complaints against her one was filed by the general attorney Abd Alraheem Alkhair representing the state prosecutor in the case of Asim Omer a student accused of killing of a policeman during last April University of Khartoum protests, Ms. Al-Sideeg wrote an article under her regular column Bila Hidood (Without Border) titled (the General Attorney Scandal) regretting the failure of the legal system in the country after the Khartoum North criminal court judge issued an order preventing the general Attorney from representing the plaintiff case due to his misconduct during the defense cross examination, the general attorney was dictating the answers in writing to the witness, the second complaint was filed by Nasir Abo-Algasim a member of Khartoum legislature council and a member of the ruling party NCP in Aljeraiaf district, in Khartoum after the paper published Ms. Al-Sideeg article accusing him of land grabbing in the area. • On the 12th of October 2016, the National Intelligence and Security Service (NISS) arrested journalist Amir Yassin of the printed daily newspaper Al-Ray Alaam, the NISS interrogated Mr. Yassin for several hours regarding a press report on the presence of carcinogenic substances and waste inside the tannery in southern Khartoum he had published with the paper. • On the 8th of October 2016, the National Intelligence and Security Service (NISS) summoned journalist Shaza Elshaikh of the printed daily newspaper Al-Jareeda, the NISS interrogated Ms. Elshaikh for three hours on a press report she had published with the paper on land corruption in Almanagil locality in Jazeera state. Ms. Elshaikh told Huqooq that the NISS officer who interrogated her ordered her to disclose her sources of the information. • On the 30th of October 2016, National Intelligence and security Service NISS with support of University of Al Fashir guards broke onto a sit-in organized by the students of the Faculty of Medicine at El Fashir University against the rise of tuition fees ,the students were attacked with tear gas, batons and hoses, number of students reportedly being injured as a result of the attack by the forces to disperse the crowd, the following are the names of those among the injured: Ahmed Eltayeb Bakor, right hand fracture, Adil Abd Alkareem, head wounds, Tahani, Roaa , and Sarah Adam. • On the 23rd of October 2016, the resident of Al-Jeraif East District in Khartoum organized Civil disobedience, the area witnessed closure of most of the local shops, schools and the market in protest against land grabbing and selling to investors and confiscation of agricultural lands and Bricks kilns. On the 24th of October 2016, police forces in 38 police trucks and 20 pick-ups stormed the sit-in area using rubber bullets and shot bullets into the air, threw teargas into the
tent and houses, beat scores of residents trying to disperse the crowd, the police forces break into the tent where protesters were gathered they confiscated the sound system and destroyed number of chairs, according to eyewitness account told Huqooq the clashes became violent between the protestors and police when finally the police forces withdraw from the area and based at Al- Manshya bridge near Sharg Alneel hospital, he further stated that on 25 October a force in plain clothes and 65 pick-ups tried to break into the area the force used excessive force by throwing tear gas into the houses and firing live ammunition as a result five people were injured among them two persons with gunshots wounds, the NISS arrested number of Al-Jeraif East disobedience committee members, they were taken to Helat Koko police station and transferred to the NISS office in Bahri near Shandi bus station the political department, on 26 October the NISS with support of the police forces tried to break into the area for the third time, the forces used bloodhounds for chasing the protesters and used intensive tear gas that led to several cases of asphyxiation among the residents, the eyewitness told Huqooq the forces is still surrounding the area. Huqooq team was unable to obtain the full names of the arrested and detailed information on the injuries- a list of some injured people withhold by Huqooq for further details. (Source: interview with Eyewitness on 26/10/2016) • On the 23rd of October 2016, at around 13:30 pm the newly formed University of Khartoum police forces arrested and detained Abd-Allah Adam Mohamed Idris (Bolad) 26 years, student at Sharq Alneel University Faculty of Economic at his 3rd year, originally from Darfur he was intending to participate in Darfur Students Association political forum at the University of Khartoum, the police arrested Bolad from inside the University of Khartoum premises near Alnshat gate, and then took him to the university guard offices without asking him about his university ID, when the police searched him they found a university ID of another student from Khartoum university on him, at this point the police handed him to allegedly NISS agents who took him to Khartoum North police station, at the police station Bolad insulted by the police and NISS agents using racial language against him and subjected him to degrading treatment , he was charged with personating others under article (113) of the Criminal Law of 1991, he was then released on bail.(source: Interview with on 24/10/2016 Bolad by Huqooq team)

• On the 21st of October 2016, the National Intelligence and Security Service (NISS) in Barbar city- Nahr Alneel State raided the Communist Party premises and canceled the symposium organized by the party to celebrate 52 year anniversary of October revelation and 70 years of the establishment of the Communist party, although the party has obtained authorities permission to conduct the symposium, the NISS overturned the permission by putting challenging requirements such as transferring the symposium venue from Barbar Sport Club to the party’s premises, obtaining the commissioner and the locality approval on Friday where all the government offices are closed, the event organizers decided to carry out the event as planned despite the NISS demands and advertised the event in the local media, at around 5:30 pm the NISS agents arrived in four pick-ups heavily armed accompanied by riot police forces, the forces dispersed the crowd violently and closed the party premises. • On the 18th of October 2016, National Intelligence and Security Service NISS in Khartoum refused to provide Al Eslah Alaan party (Reform Now) with permission to conduct its symposium that planned to take place on 19 October, in Buri Hasheesh neighborhood in Khartoum, according to one member of Al Eslah Alaan told Huqooq that on 8 /10 we approached the police authorities in Khartoum locality to inform them and obtain the permission for the symposium the authorities referred our letter to Khartoum State police and then to the NISS, the later notified us verbally we are banned from conducting the symposium, adding that this is second time in this year our political activities to be banned by the authorities. Background and Context:
On the 6th of October 2016, The Central Committee of Doctors announced a general strike across the country, calling for the improvement of the health sector in Sudan. On 13 October the doctors suspended the strike for one week after meeting with the vice president Hasabo Mohamed Abd Al Rahman and the Minister of Health Bahr Abo Girdah, the government agreed to respond and fulfill the doctors demands, the doctors committee announced the resumption of their strike following the government failure of executing the demands as agreed and promised within a week.
Arbitrary Arrest and Detention:
• On the 31st of October 2016 at around 10:00 am, National Intelligence and Security Service NISS in Khartoum summoned the political secretary of the Communist Party in Khartoum Masoud Mohamed Alhassan, in his early fifties and a civil servant at Khartoum Hospital, according to one
Communist party member told Huqooq that the reason of the summon of Mr. Alhassan thought to be linked to the doctors strike.

• On the 30th of October 2016, some 12 National Intelligence and Security Service NISS armed agents in a pick-up arrested Alsir Aljezoli Saeed from his house in Al Jeraif East district in Khartoum, in connection to the residents of Aljeraif protests against the land grabbing and confiscation by the government. Noting that numbers of Al Jeraif East disobedience committee members are still in detention since 23/10/2016 Huqooq team was unable to obtain their full names and further information due to security restrictions. • On the 20th of October 2016 at around 4:00 pm the National Intelligence and Security Service (NISS) in Barbar City Nahr Alneel State arrested Adil Alsayed 45 years,Alfadil Jaafar 40 years and Osama Abd Almoniem 22 years, they were arrested during their driving around the city to make announcement for the Communist Party symposium, they were interrogated for two hours and released on the same day without charge. • On the 21st of October 2016, the National Intelligence and Security Service (NISS) in Barbar City Nahr Alneel State arrested Osman Taj-Alsir and Alsir Ali Alhassan from the street near the Communist party premises in Barbar city after the NISS broke into the party premises, the NISS interrogated them for two hours, according to one Communist party member told Huqooq that the NISS beat the two arrested men and subjected them to torture, as a result of the beating Alsir Ali Alhassan ears seriously injured. They were released on the same day without charge. (Interview with Communist party member on 26/10/2016)

• On the 18th of October 2016 at around 3:30 pm National Intelligence and Security Service NISS arrested Mahmoud Abdo Mustafa 62 years a member of the Communist Party and from Nubian ethnic group (North Sudan), he was arrested from his house in Aldroushab neighborhood in Bahri Khartoum, according to Mr. Mustafa told Huqooq that At around 3:30 pm someone knocked on the door, and asked for me when I attended he asked for a house for rent at that moment a shaded double cabin approached carrying four individuals dressed in plain clothes who get off carrying small pistols and asked me to go with them to a nearby I asked them to where and who are they? They said we are NISS and we want you for minutes, I told them I need to get dressed they said no you will come back soon, then they drove me to the security office in Hilat Hamad near the cemetery, I was interrogated by four people three in plain clothes and one wearing a uniform without signs, the first interrogation started at around 9:00 pm, then they told me you will be interrogated by a high rank upon his arrival, the second interrogation began at around 11:00 pm, the interrogation was on distributing leaflets and that I am forming and mobilizing for resistance committees. After the completion of the investigation he ordered them to transfer me to the Political Security offices, but one of them intervened and asked for
my release, but I have to report in the morning as I am an old man, I was released late that night and I did not go next day as I was ordered, however the NISS agents have remained calling me on the phone ordering me to report, I went to them on 20 /10 and then told me that to go to another office located in the (West of the fuel station in Ingaz street) but I did not go they are watching me and came to my house from time to time. (Interview with Mahmoud Abdu Mustafaf on 30/10/2016) on 31/10/2016 Mr. Mahmoud informed Huqooq that he was summoned today by the NISS.
Death of a Student:
• On the 23rd of October 2016, at around 10:30 pm, Adam Yahiya Haroun, 24 years, student at Sudan University of Science and Technology, 3rd year at the Faculty of Information Technology, residing in Omdurman Islamic University students dorm in Alshigla area in Omdurman, originally from Baleel Locality Kalma IDPs camp- South Darfur, was found dead by one of the students at the Omdurman Islamic university Faculty of Pharmacy near the students union premises, according to the student who found the deceased he said that he noticed signs of torture on the deceased shoulder and neck, he then carried the body whilst at the dorms gate met with four people in plain clothes in a pick-up who took the body from him and inform him that they will take the deceased body to the Medical Military Hospital, one of the deceased relative told Huqooq that he received a call from stranger informing him to go to the hospital and receive the body, according to one of the student activist told Huqooq that the death certificate issued by the Medical Military Hospital stated the cause of the death is severe beating at the deceased neck and other parts of the body, later the body was transferred by security agents to Omdurman Educational Hospital morgue where they obtained another death certificate stating the cause of the death is electrocution. The family of the deceased received his body by the same four people who took him to the Medical Military Hospital and disappeared thereafter. (Huqooq team tried to obtain more information from one of Haroun family members he refused to talk or provide more information and told Huqooq he was threatened by the NISS not to talk about Haroun death with anyone or he will see other things he said his mobile is monitored now and can’t talk then he switched the phone off.
The Context:
On the 19th of October 2016, the student’s unity association at Omdurman Islamic University organized a political forum and handed a memo to the students fund demanding the opening of the student’s dormitory, that was closed during the student’s protests in last April, later on the same day group NCP party affiliated students stormed the dorm of the faculty of pharmacy students and questioned two students on the political forum and who are the organizers and the leaders of the student unity movement, they found Adam Yahiya Hroun and beat him. On the 20th of October the students opened the dorms and found no water and the power was off, later the NISS agents surrounded the dorm with their pick-ups. (According to one student he said they are suspecting that Haroun was killed, Huqooq team was unable to obtain further information).
Excessive Use of Force:
Kokary Village-Sinnar State:
• On the 23rd of October 2016, at around 8:00 am Yousif Malik Ali, 38 years old and a farmer from Kokary village – Abu Houjar locality Eastern Almazmoom city in Sinnar State 20 Kilometer from south Sudan border has died of a gunshot wounds to the chest and run over by police vehicle, the Central Reserve Police forces (known as Abu Tira) attacked the farmer Yosif Mlik Ali, whilst he was cultivating Sesame crop in his farmland, the police ordered Yousif to stop cultivating, the deceased refused to obey the order and clashed with the police then the police fired live ammunition and shot him dead, one Kokary resident told Huqooq that the police ran over the deceased body with a police vehicle after he shot him, the killing of the farmer provoked the residents of the village and tribe people who went in protests at 5:30 pm the violent clashes started between the police and the residents, the police fired live ammunition and killed Alsadig Ehaimir a 22 years old and a herder, two persons were seriously injured Atta Almanan Yousif Yagoub a farmer and Alsamani Abd Alrahman Al Fadil a farmer, who are now receiving treatment at Wad Madani Hospital in Aljazeera state. According to the resident account 10 policemen were killed during the clashes and the villagers seized the police weapons, chased them out of the village, and burn down their camp. The resident told Huqooq that the authorities responded by appointing a committee of inquiry to investigate the incident, and withdrawal of the Central Reserve Police which replaced it with Military forces. He further stated that although the situation is calm but it might explode anytime.

Darfur Region Violations: • On the 26th of October 2016 at around 7:00 pm, five Janjaweed militia on horses in Garsila Wadi Salih locality Central Darfur State in Jedo area, shot dead Younis Yagoub Abd-Almoula, 56 years a farmer from Garsila Aljableen IDPs camp, he was shot dead on his way back home from his farmland with his two daughters and son, the family attacked by the Janjaweed and tried to rape his two daughters the deceased tried to defend his daughters by using a knife when the militia shot him to the chest and escaped. (Source Huqooq team in Darfur) • On the 24th of October 2016, the police and Sudanese Army forces from the division 15 military base in Sirba, shot dead Hamdan Mohamed Saeed 41 years a herder from Abo Srooj village/Sirba locality West Darfur State, after he entered his camel to graze on a farmland of Abakar Yahiya Abakar a farmer who called Abo Sorooj police in Sirba locality complaining the unlawful entry to his farmland by Hamdan (the herder) with his camels, the forces came and tried to arrest the herder and remove his camels from the farm which has led to clashes between the forces and the herdsman then the later (the herder) fired bullets into the air from his gun when the army shot him to the chest and died on spot. The body of Hamdan was transferred to El-Genina hospital. (Source Huqooq team in Darfur) • On the 22nd of October 2016 at around 2:00 am, unidentified armed group attacked Ali Mohamed Ahmed Alzaki, 24 years at his shop in Almawashi block in Nyala South Darfur State the attackers shot him to his thighs and looted his shop.

• On the 20th of October 2016, at around 5:00 pm the National Intelligence and Security Service (NISS) arrested Alfarshah Salih Arbab from his house in Althawra block in El-Genina locality West Darfur State, the arrest reason thought to be linked to Mr. Arbab visits to Al-Sisi IDPs camp following series of killings and attacks incidents against the IDPs in Al-Sisi camp by Janjweed militia.

• On the 20th of October 2016 at around 3:00 pm, Dahyah Adam Karama 38 years a farmer was attacked by a group of armed herdsmen some of them dressed in military uniform and others in plain clothes, the armed herders entered their camels onto the farmland of Dahyah, when he tried to remove their camels from his farm in Alban Jadeed village in Sirba locality they shot him and wounded his left-shoulder, according to one relative told Huqooq a group of herder men with a large herd of camels entered onto the farmland of Dahyah when he chased the camels out of his farmland one of the herdsmen whipped him he tried to defend himself with an axe another herdsman shot him at his shoulder, Dahyah transferred to Sirba hospital for treatment (Source Huqooq team in Darfur)

• On the 19th of October 2016 at around 8:00 pm the National Intelligence and Security Service (NISS) arrested two community leaders from Karandaig IDPs camp in El Genina locality West Darfur the names of the arrested are: Khamis Suleiman Abd-Allah 46 years and Jumaa Zakaria 43 years, on the ground of their participation in a meeting with other community leaders from Al- Sisi IDPs camp to discuss the insecurity situation in Al-Sisi camp.

• On the 13th of October 2016, Janjaweed militia shot dead Hawa Adam Mohamed Abakar 50 years from Azirni in Kereinik locality West Darfur whilst she was working at her farmland.

• On the 11th of October 2016 at around 5:00 pm, Abdo Arbab 43 years resident of Alshati area in Bida locality was shot mistakenly by Sudanese army forces officers in Bida locality West Darfur State whilst they were chasing a person on a motorcycle in Gandi Valley near Bida locality, Mr. Arbab was on his way back to his home from his farm when he was shot, he sustained serious injuries and transferred to El Genina hospital, he died on 16/10/2016 as a result of the gunshot wounds. • On the 9th of October 2016, a group of Janjaweed militia beat Sarah Mohamed 25 years a widow and resident of Alimtidad neighborhood in Kereinik locality Murnei unit in West Darfur, the attackers entered their animals to graze on the farmland of Sarah when she opposed them and tried to defend her farmland the militia severely beaten her with sticks she was seriously injured, later she was transferred to El Genina hospital for treatment.

• On the 5th of October2016 at around 9:30 a Military Air Defense sergeant in military uniform opened fire on a group of people at Hai Al Jebel market in Nyala South Darfur State he injured a
woman suffering mental illness and living in the market she sustained gunshot wounds at her back, Hafez Adam Hussein 41years he was sustained gunshot wounds to his forehead and Hussein Adam Al-Doom 40 years he was wounded in his chest, right arm and leg, all were transferred to Nyala hospital in serious condition. • On the 4th of October 2016, two armed men shot and injured Mubark Shatah Titi 29 years, and Mohamed Ishaq 24 years in North Aljeer area in Nyala South Darfur State, the authorities arrested one of the attackers however he was released after two days by his uncle a member of the Rapid Support Forces. • On the 4th of October 2016, National Intelligence and Security Service (NISS) arrested students Almardi Mukhtar 21 years University of Al Fashir faculty of Medicine third year, Modar Ishaq Abakar 25 years Faculty of Medicine sixth year, Ali Ismail Ali 26 years Faculty of Medicine sixth year, the students were protesting against the rise of the tuition fees the NISS took them to Alawsat police station, they were released after interrogation on the same day without charge.

• On the 3rd of October 2016, unidentified four armed men in a Land Cruiser with no plates shot dead Mohamed Abdelkarim 36 years, the bodyguard of the Commissioner of Almalam locality East Jebel Marra in South Darfur and the commissioner’s driver El Haj Adam Ishag 38 years the attackers looted the Commissioner’s new car and escaped.

• On the 3rd of October 2016, the Criminal Court in El Geneina West Darfur sentenced Mubarak Abdel Hakam El Khair 29 years, a student at El Genina University and political activist with one year imprisonment and a fine of 12,000 SDG for causing intentional wounds under article(139) of the criminal law of 1991, Mubarak was arrested on 31/1/2016 by the National Intelligence and Security Service NISS, after the NISS stormed the university campus following the violence surrounding the bread demonstrations and the killing of the student Salah Gamar, Mubarak was detained for 11 days at the NISS offices in El Genina and reportedly he subjected to torture during his detention in the NISS custody, then he was transferred to El Genina police station on 11/2/2016 the NISS accused him of stabbing a member of the NISS during the demonstration, Public Nuisance and disturbance of public peace.(Source: Huqooq team Darfur)

• On the 2nd of October 2016 at around 2; 30 am, a group of six armed men dressed in military uniform covered their faces with what known in Darfur (Kodomol) attacked the house of Mohamed Adam in Kanjomiya area eastern the stadium in Zalengi Central Darfur State, Mohamed Adam is a casual worker on a cart, the attackers opened fire, as a result of the attack Ayah Mohamed Adam a 13 years old was injured and Mohamed Adam sustained serious injuries he was in coma, they were transferred to Zalinji hospital for treatment.

Public Order Law Al Daein East Darfur:
• On the 18th of October 2016, the Police forces broke into Creo camp for South Sudanese refugees southern El-Daein locality in East Darfur state, during a sweep campaign against local Alcohol brewer, eyewitness from the camp told Huqooq that “police forces in police truck led by lieutenant has stormed the Creo camp at 12:00 pm, the camp is hosting about 3,200 refugees from South Sudan clashes erupted between the police and the refugees, the police used batons in beating the refugees, as a result number of refugees were injured among them Mrs. Aloe Dut Pack who was seriously injured after the police hit her to the head with gun butt she was taken to Al-Daien hospital for treatment, the police arrested approximately 15 people during the raid.
On the 19th of October 2016, in the morning the police forces and allegedly NISS agents in plain clothes arrested the community leader Ibrahim Aweel Ding, 55 years from Al-Daien hospital whilst visiting the injured persons, he was taken to Aldalibah police station south Alsouq Alkabeer( the grand market) he was detained with other arrested persons at Aldalibah police station , the names of among those arrested: –
1. Marco Lanao Walit, 34 years
2. Rebecca James Tasweer, 46 years
3. Garang Chowt Agot, 37 years
4. Allot wot Pack, 32 years
5. Allot Ding Waw, 34 years
6. Sharief Ibrahim Weall, 24 years
7. Mareik Ding Ding, 30 years
8. Joseph Nuke Alao, 24 years
On the 20th of October 2016, the judge of the public order court in Al-Deain Mohamed Khidir, convicted the arrested people under Obstructing public servant from performing the duties of his office article (99) and Intimidation article (144) of the Criminal Law of 1991, the arrested were sentenced with 40 lashes, three months imprisonment and with fine 5000 SDG for each with exemption of the community leader Ibrahim Aweel Ding and Rebecca James. Freedom of Religion; Intimidation of Sudanese Christians:
• On the 14th of October 2016 at around 12:30 am, the police forces in Wad Madani Al Jazeera State arrested nine members of the Evangelical Church and brought several charges against them under article (77) Public Nuisance, (67) Riot and (Criminal trespass) of the Criminal Law of
1991, all the arrested were released on the same day four of them released on personal bail the rest were released on financial bail of 6000 SDG.
According to the account given to Huqooq by a member of the Evangelical Church ( Shaikh Dawood), he told Huqooq that the reason of the arrest, on Tuesday, 14 \ 10 some opponents of the church system who have been appointed by the Ministry of Endowments and Guidance, against the well of the elected members, stormed the Evangelical Church school building in Wad Madani, Al Jezeera State, the church has made two administrative appeals rejecting the appointment, the court has issued its decision in favor of the Appellant. At around 2:00pm the emerging group (appointed by the government) occupied the school building by force and with the help of some people who do not belong to the Christian faith and not from Wad Medani, I went to Alawsat Police Station (Central police station) in Wad Madani to file a complaint against them, however, the police officer refused to file the complaint or execute the court and prosecutor orders to evacuate them from the school building, at around 12:30 am members of the Evangelical Church went to the church building and clashes erupted between the two groups, then the police interfered and arrested nine members of the church, the following are the name of the arrested:
1- Samuel Suleiman (priest and the school headmaster)
2- Zakaria Ismail (Priest)
3- Makram Borai (church member)
4- Alshazli Jumaa (church member)
5- Jenwar (verger)
6- Salim (verger)
7- Abd Almaseeh (member)
8- Kodi (member)

Right to Work:
• On the 26th of September 2016, the Director of irregularities of Khartoum locality in Khartoum ordered the tea ladies based around the Al Saha Alkhadra (Green Yard) to evacuate the area and stop working for 15 days due to the National Dialogue celebrations that took place in Al Saha Alkhadra (Green Yard) in order to maintain a civilized environment around the area. The tea ladies followed the decision vulnerably. However when they came back to work in Al Saha Alkhadra (the Green Yard) after two weeks, they found the area surrounded by police trucks and local authority personnel. The locality officers told them they are not allowed to work at the area or any nearby place, otherwise the authorities will confiscate their belongings. The majorities of the tea ladies are selling tea as a mean of living and to support their dependents.
